M/S. Gurudaya Builders, through Parnters, Vinod Premchand Chandwani and Anr. Vs the State of Maharashtra, through Urban Development Dept and Ors.

The learned counsel for the Petitioners has submitted a representation dated 09.05.2012 to the State of Maharashtra whereby the Competent Authority is requested to treat the lands in question as free hold lands and permission to develop the same in view of the repeal of the Urban Land (Ceiling & Regulation) Act 1976 is pending for decision, hence, may be asked to decide the same.

Learned AGP states that the said representation, if not decided earlier by the State Government, will be decided in

accordance with law and the procedure applicable in this regard within eight weeks from the date of communication of this order.

In view of the statement of learned AGP, we dispose of the Petition accordingly, however, it is made clear that we have not expressed any opinion in respect of the issue involved on merits. It is entirely for the State Government to consider the issue in accordance with law and the procedure applicable in this regard on its own merits and to decide the same. The learned counsel for the Petitioner undertakes to appear before the State Government on 21st August, 2012.
