During pendency of this petition, the Caste Scrutiny Committee has rejected the caste claim of the petitioners. The petition has, therefore, become infructuous. At the time when the petition was filed, the claim of the petitioners was not decided and adjudicated by the Caste Scrutiny Committee. Since this petition has become infructuous, liberty is granted to the petitioners to challenge the order of the Caste Scrutiny Committee. It will be open for the petitioners to take all the points raised in Civil Application No.924/2011 in case the petitioners file fresh petition and the points raised are permitted in fresh petition to

be filed by the petitioners. Said liberty is granted to the petitioners. The petition is disposed of as infructuous. Civil Application is accordingly disposed of. It will be open for the petitioners to take up all the points available to them in law including those which are raised in the present petition since the petition is not adjudicated upon on its merit.
