Heard both sides. Perused the orders passed by the Revenue authority and confirmed by the Administrative Tribunal. Upon perusal of the same, to my mind, essentially the impugned orders of Revenue do not conclusively and finally determine the rights of the parties in immovable property. It would be open for the petitioners therefore, to approach a competent Civil Court and claim such declaration as is permissible in law with regard to the right, title and interest in the immovable property.

I have no doubt in my mind that the competent Civil Court will adjudicate said right on the basis of oral and documentary evidence placed before it and uninfluenced by the conclusion of revenue authorities. Writ Petition is disposed off with this clarification. To enable the petitioners to approach competent civil Court and for obtaining interim order from the same, interim order passed by this Court on 6.5.2010 in terms of prayer clause (c) of this Writ Petition

shall continue for a period of eight weeks but it is clarified that the grant as also the continuation of the order is without prejudice to the rights and contentions of all the parties. Needless to clarify that all the contentions of all the parties are kept open.
