That one Mahadu Jadhav was in occupation of the slum structure continuously even before the cut-off date i.e. 1.1.1995 till the date of

implementation of the S.R. Scheme. Mahadu Jadhav was, therefore, shown to be eligible being the actual occupant. The High Power Committee on these undisputed facts held that Satvashila Mahadu Jadhav, widow of the original occupant is entitled and eligible under the S.R. Scheme. Perusal of the order shows that the High Power Committee considered the provisions of regulation 33(10) and decided the issue in question in view of these undisputed facts.
4. Writ Petition is dismissed.
