Ms.Sharmila Deshmukh, learned counsel for respondent No.2-Maharashtra Coastal Zone Management Authority states that the impugned decision dated 15 May 212 (Item No.60) at Exhibit “M” to the petition is being withdrawn and that the Writ Petitioner will be given an opportunity of being heard and thereafter fresh order will be passed in accordance with law. She further states that the matter will be heard on 3 November 2012. The learned counsel further states that since this statement is made in the presence of the learned counsel for the petitioner no fresh notice will be issued to the petitioner.

The learned counsel for the petitioner states that the Writ Petitioner will appear for personal hearing before respondent
