After hearing the learned counsel for the respective parties for some time, Mr. Apte the learned senior counsel appearing for the respondent no.2 states on instructions from his client, who is present in the Court that the respondent no.2 has no objection for setting aside the impugned order passed by the Divisional Joint Registrar on 5.1.2012 in Revision Application No.395 of 2011. In view of the consent, reasons need not be given for quashing the said order. Writ Petition is accordingly made absolute in terms of prayer clause (a).

2 Respondent No.2, however, is at liberty to challenge the election to the Managing Committee of the petitioner-society held on 31.7.2011 under Section 91 of the Co-operative Societies Act before the Co-operative Court. If the respondent no.2 files such dispute as stated above within a period of three weeks from today, the concerned Co-operative Court shall dispose off the same as expeditiously as possible and preferably within a period of one year. It is expressly made clear that I have not gone into the legality of the election to the Managing Committee and the Co-operative Court shall decide the same in accordance with law. Needless to mention that the respondent no.2 can take advantage of the provisions of section 14 of the Limitation Act for the purpose of condonation of delay.
