 Heard learned counsel for the parties.

1. By this Petition which is filed under Article

226 of the Constitution of India the Petitioner
is seeking a writ, order and direction directing

the Respondents to forthwith decide the

¶17

application for parole of the Petitioner and till

¶18

the application is not decided to release the

¶19

Petitioner on parole leave. It is further
submitted that though it is the duty of the

competent authority to decide the application for
parole and furlough expeditiously the Respondents
have failed to dispose of the application and as

a result the Petitioner was unable to avail of

¶23

the furlough leave for the year 2011. It is

¶24

further submitted that the Petitioner�s wife is
suffering from TB and therefore, he is seeking
extension of furlough leave and he was released
on furlough for a period of 15 days on 19.2.2012

and the period of 15 days has expired.
Thereafter, the present Petition has been filed.
The Petitioner was supposed to surrender on
18.3.2012. The time to surrender however, was
extended till 21.3.2012.

2. We have perused the medical papers of the
Petitioner�s wife. In the medical papers, it is
nowhere stated that the Petitioner�s wife is in
an advanced stage of TB and that she is likely to
expire within a short time. The reliefs claimed

by the Petitioner in this Petition is for
expeditious disposal of parole application. We

are inclined to give that direction in this
Petition. However the Petitioner will have to
surrender on or before 26.3.2012. After the
Petitioner surrenders, the Respondents are
directed to decide his application for parole
expeditiously within a period of four weeks.
