. The present appeal is filed against the
Award under Section 140 of the Motor Vehicles
Act. Proceedings under Section 166 of the
Motor Vehicles Act is pending since the year
2008. Involvement of the vehicle is disputed.

2. Learned counsel for the appellant submits
that at present claimants evidence is
complete.

3. In view of the above, I am not inclined
to consider the appeal on merits, the cause
of substantial justice would be sub-served

the proceedings under Section 166 of the
Motor Vehicles Act are decided expeditiously.
In the result, I pass following order.

4. The Tribunal shall decide the proceedings
under Section 166 of the Motor Vehicles Act
as expeditiously as possible and in any case
within a period of six months from today.
The amount deposited by the appellant in this
Court be transmitted to the Tribunal. The
Tribunal shall disburse the said amount as
per the Award passed under Section 166 of the
Motor Vehicles Act.

5. The Appeal is disposed of accordingly. No
order as to costs.
