Respondent no.2 died on 09.02.2011. It is stated that the fact of her death came to the knowledge of the appellant on 17.12.2011. Diligently, the application was filed on 29.02.2012.
For the reasons stated in the application, abatement of the appeal, so far as it relates to respondent no.2, is set aside. Delay caused in filing the application in bringing the legal heirs on record is condoned. Legal representatives of respondent no.2 be brought on record. Necessary amendment be carried out within a period of one week.
