Heard the learned counsel for the applicants.

This application is for bringing legal heirs on record of deceased appellant no.1, Dnyanu Balu Kenjale @ Phadtare who died on 14.02.2012.

Considering the submissions made by the learned counsel for the applicants and the averments made in Civil Application, I am satisfied that the applicants have made

out a case for allowing the Civil Application. Hence, Civil Application is allowed in terms of prayer clause (b) and (c) which reads thus:

“(b) The delay of 65 days that has occurred in filing the present application, be kindly condoned in the interest of equity and justice.

(c) This Hon’ble Court be pleased to allow the present application for substituting the name of original Appellant No.1 – Shri Dnyanu Balu Kenjale @ Phadtare with his heirs and legal representatives being the Applicants No.1/A to 1/E mentioned in the cause title of this application and further allow the Applicants to amend the cause title of the memo of Second Appeal No.352/2011 as well as Civil Application No.877/2011 therein accordingly, which are pending for admission before this court.”
