Heard Shri Pathan, learned counsel for the applicant/ petitioner/ employee. Nobody appears for the respondents, though they are served.
Shri Pathan, learned counsel states that he reached Court late on 25.11.2009 and in the meanwhile the matter came to be dismissed. As the applicant is from Bihar, he could come only after receipt of intimation and that took time of about 11 days more than the prescribed period of limitation.
As we do not see any malafides, we condone delay and recall order dated 25.11.2009. Writ Petition No. 4172 of 2009 is accordingly restored to file. List writ petition for admission on 3rd February 2012.
