Hence, the order of dismissal of this application as against Respondent No.1(3) is hereby recalled. The contesting Respondents have been duly served. In view of the averments made in the application, a case for restoration is made out. Application is allowed in terms of prayer clause (b). Application is disposed of with no order as to costs.

The learned Counsel for the Petitioner states that the Petition has already been reconstructed. Issue notice of restoration of the Writ Petition to the Respondents. In addition to service of notice through Court, Advocate for the Applicants shall serve private notice by Registered Post A.D. and/or by courier service and/or by hand delivery to the Respondents as regards restoration of the Writ Petition and shall file affidavit of service one week before the returnable date.
