Heard Mr. S. Shakil, learned Advocate for the Applicant and Ms Rashi Deshpande, learned APP for the respondent-State.

It appears that the applicant was arrested only on the basis of suspicion in connection with Crime No. 121/2011. The applicant came to be arrested on 25/06/2011 and ever since he is in jail. Learned APP also does not dispute the submissions that pursuant to the love affair with wife of the deceased, the applicant was arrested. As such, there is no material collected during the investigation so as to attribute the present applicant with the said offence of the murder and, hence, possibility of his conviction for the offence of murder is remote at this stage. is, therefore, allowed. The applicant is granted bail on the following conditions.

The applicant in Crime No. 121/2011, registered at Police Station Mouda, Dist. Nagpur, for offence punishable under Section 302 of the Indian Penal Code read with Section 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, be released on bail upon execution of personal recognizance (P.R.) bond in the sum of Rs. 50,000/(Rupees Fifty Thousand only) with two solvent sureties in the like amount.

The applicant shall attend the concerned Police Station, as and when called by the Investigating Officer.

The applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing facts to the Court or to any police officer.

The applicant shall not tamper with the prosecution evidence or witnesses.

The applicant shall inform his correct address, if any, to the Investigation Officer and learned trial Court concerned.
