3 The FIR refers to an oral dying declaration allegedly made by Geeta to her brother-Pandit Prakash Patil-the first informant. Mr.Ingawale, the learned advocate for the applicants submits that inspite of such a dying declaration, no report was lodged by the first informant with the police till 22.12.2011. He also drew my attention to a dying declaration of Geeta recorded by police, in which she mentioned the death to be accidental. According to the learned APP, the said dying declaration could not be relied upon as there was other material to indicate that it was given by the deceased in presence of her father-inlaw. Without going into the reliability of the said dying declaration, it may be observed that the first informant and other relatives of Geeta had made an application to the Superintendent of Police, Kohlapur on 22.12.2011 itself, and in this application they mentioned that they were suspecting that there was some fowl play in the death of Geeta.
