Heard learned Advocates on both sides. The applicant is facing trial in Sessions Case No.133 of 2011. The charge is already framed. Trial has commenced. Examination of complainant P.W.1 is part recorded. Learned Advocate Mr. Singh appearing on behalf of the applicant submitted that charge was framed on 8.8.2011 and as of today the evidence of P.W.1 is part recorded. He submitted that all the four accused facing trial, including the applicant are in custody. He submitted that the trial is going on at a slow pace. Learned Advocate Mr.Singh submitted that if the court is inclined to expedite the trial, his client would not press the bail application.

After having considered the submission advanced by the learned Advocate for the applicant, looking to the record and after noting that there are as many as 60 witnesses, the learned Addl. Sessions Judge, Bombay before whom the trial is pending will have to be given reasonable time to hear and dispose of the case. In my view, as all the accused are in custody, it would be possible for the trial Judge to give priority to this case and dispose of the same as expeditiously as possible and preferably by 31.12.2012.

In view of the above, following order is passed.

ORDER

i. The learned Addl. Sessions Judge before whom Sessions Case No.133 of 2011 is pending shall hear and dispose of said case as expeditiously as possible and preferably by 31.12.2012.

ii. Bail application is disposed of in above terms. It is clarified that this Court has not expressed any views on merits.
