There is nothing in the papers shown to me by the learned APP to indicate that just before the incident there was any provocation given by the applicant to make the victim to take precipitate step. Considering the nature of allegations made, the applicant's being in custody pending further investigation or trial may not be necessary. The application is, therefore, allowed. The applicant arrested in connection with C.R. No.152 of 2012, registered with Vishrambag Police Station, Sangli, be released on bail on his furnishing P. R. bond in the sum of Rs.50,000/- with one or more solvent sureties in the aggregate sum of Rs.50,000/- on the condition that the applicant shall report at the concerned police station on first Sunday of the month, till the trial is over.
