1. Heard Mr.Subodh Desai, learned Advocate for the
Petitioner and Mr.Udayan S.Jain learned Advocate for
Respondent nos. 2,3 and 4.

2. Mr.Jain submits that during the pendency of the

present Application which is for cancellation of the
anticipatory bail granted to the Respondent nos. 2,3

and 4 by the Court of Sessions, Mumbai further
developments have taken place. He submits that
thereafter the Police have completed the
investigation and concluded that the report had been
lodged with the police falsely and malafidely. The
Police after investigation, released the Accused
under section 169 of the Code of Criminal Procedure,
1973 and asked for classification of the case as 'B”
summary. On that report of the Police, notice has
been issued to the First Informant by the concerned
Magistrate. A true copy of the Report filed by the
Police and the Roznama dated 26.3.2012 tendered by
the learned Advocate for the Respondent nos. 2,3 and
4 is taken on record.

3. Since, after investigation, the Police have
come to the conclusion that there is no substance in
the complaint against Respondent nos. 2,3 and 4 and
that it was a false complaint, there is no point in
keeping the Application for cancellation of the
Anticipatory bail granted to the Respondents pending
as suggested by Mr.Subodh Desai.

4. Undoubtedly, the First Informant shall be

entitled to oppose the grant of 'B' summary; and in
the event of his succeeding before the learned

Magistrate, he shall be at liberty to make a fresh
Application for cancellation of bail. Because of
such possibility, however, I am not inclined either
to keep the present Application pending or to allow
it.

Application is dismissed with aforesaid
