.The applicant seeks bail pending disposal

of the revision application. The applicant is in

jail at the moment. The applicant is convicted

under Section 138 of the Negotiable Instruments
Act concurrently by the Courts below. The cheque
in question was of Rs. 82,000/-. It was issued
some time in 2002 and yet the applicant has not
discharged his liability arising from the cheque.
The applicant has managed to keep the cases
pending before the Courts for last 10 years and
has successfully dodged the repayment. The
applicant is sentenced to suffer one year R.I. for
the offence and in view of this, I have two
choices. I would refuse the bail to the applicant
and immediately take up the revision for hearing
and dispose it of or I would grant conditional
bail to the applicant so that now he would at
least pay half of the amount of the cheque.I
find second option more suitable and it would
also benefit the respondent – complainant.

condition that he shall deposit Rs.40,000/-
(Rs. Forty thousand only) in the Court of the
J.M.F.C. on or before 20-04-2012. On depositing

the said amount, the applicant shall be released
on bail of Rs.10,000/- with one surety of like
amount.
