The case was heard on 10/02/2012. Learned advocate Mr.Warma was asked to take instructions whether the attendance of instructional course from 15/02/2012 till completion of term, would render the applicant to be eligible from the point of view of requisite attendance for appearing for the examination. The hearing was adjourned till today at the request of learned advocate for the applicant to make a statement.

Today, Learned advocate Mr.Warma states upon instructions that the attendance, which the applicant would make up during liberty may suffice and he would apply to the Principal for condoning the deficiency or shortfall if any.

In view of this statement, at applicant’s risk as regards the eligibility, this Court considers that it would be in the interest of justice this applicant can be granted temporary bail to enable the applicant to attend the instructional

course in the College and to appear for the examination between 15th February 2012 to 15th May 2012.

Hence this application for temporary bail is allowed to said extent indicated in the foregoing para.

The applicant shall furnish personal bond and solvent surety in a sum of Rs.20,000/- and shall report the concerned police station for marking his attendance, once in a week, on every Monday evening, between 5 to 6 p.m. He shall surrender on due date i.e. in the evening of 15th May 2012.

Application is partly allowed and disposed accordingly.
