While issuing notice in this appeal on 2 August 2012, we had granted ad-interim stay of the impugned order of winding up of the appellant-company on condition that the appellant deposits a sum of Rs.2,50,000/- with the Company Registrar.

The learned counsel for the appellant-company states that the amount of Rs.2,50,000/- has been deposited with the Company Registrar of this Court.

Ms. Kavita Gowda, the respondent herein (petitioning creditor) states that if she is allowed to withdraw the amount of Rs.2,50,000/already deposited by the appellant-company, she is ready to withdraw the company petition No.168 of 2010.

The learned counsel for the appellant-company has no objection to the respondent (petitioning creditor) withdrawing the aforesaid amount and withdrawing the company petition.

In view of the above consensus, we permit respondent Ms. Kavita Gowda to withdraw the amount of Rs. 2,50,000/- already deposited by the appellant-company with the Company Registrar of this Court and also grant her leave to withdraw the company petition No.168 of 2010.

This appeal as well as company petition No.168 of 2010 also stand disposed of as withdrawn.
