The applicant is apprehending his arrest in connection with Crime No.48 of 2012 reported at Police Station, Sitabuldi, Nagpur, under Section 420 r/w. 34 of the Indian Penal Code. According to the applicant, he has no concern with the alleged incident of cheating and no prima facie case is made out against him regarding accusation of cheating. It is also submitted that the applicant is ready and willing to co-operate with the investigation if the interim anticipatory bail granted in his favour is confirmed and that he does not want to suppress anything from the Investigating Officer.

The learned A.P.P. objected grant of bail on the ground that the present applicant is involved in a serious crime as, according to the Investigating

agency, the present applicant and other accused had received money from boys and girls candidates and certain undertakings were signed by the present applicant apart from the seizure of certain blank cheques. At the interim stage, this Court had granted interim anticipatory bail on 13.3.2012 subject to certain conditions.

According to the Investigating Officer, who has filed an affidavit, the applicant/accused herein has failed to appear before the Investigating agency. I think that, considering the interest of larger public, when it is alleged that the amounts were collected from certain candidates with a view to cheat them and the applicant/accused is maternal uncle of the main accused Nilesh Tijare, I am not inclined to grant anticipatory bail to the present applicant. Needless to state that if the applicant surrenders to the custody, he may apply for grant of bail on merits. The interim anticipatory bail granted by this Court in favour of the applicant herein vide order dt.13.3.2012 is hereby vacated. The Criminal Application is disposed of accordingly.
