Heard the learned Counsel for accused-applicant. The accused applicant apprehends arrest in C.R.no.27 of 2012 of Kamti Police Station, that is a complaint initiated by Mr.Vasant Sathe being private Complaint no.359/11 dated 4.10.2011.

The papers illustrate, in terms of Section 156(3) of Cr.P.C. the investigator was directed to investigate. The complainant feels that death of Vishnu was homicidal as he was kidnapped on 18.10.2008 and thereafter, was killed. His dead body was found on 22.10.2008, he was battered.

However, police could not even after relentless efforts trace the culprit. The petitioner feels, Smt.Sujata- the widow of said Vishnu had illicit relation with Jyotiba-accused no.8. Even after the above features of the matter are taken into consideration, the investigation papers with the APP does not inform of any specific role of the accused-applicant Ravindra Tuljapurkar. He was in employment with Vishnu who has been kidnapped.

Considering these features, in the event of arrest of accusedapplicant Ravindra Tuljapurkar, he shall be released on PR Bond and Surety in the sum of Rs.25,000/- on a condition to attend investigator on every Tuesday, Thursday and Sunday between 3 p.m. to 6 p.m. till 31.10.2012. He shall not terrorise the witnesses involved and not to keep contact with them by any mode.

The accused/applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.

Application is disposed of in the above terms.
