1.Heard rival submissions on earlier date
on this application for anticipatory bail,
preferred by the applicant, apprehending his
arrest in the matter of complaint lodged by one
Prakash Bhotmange against the applicant and one
Shrawan Wakodikar. It appears that said Prakash
Bhotmange had lodged written complaint to the
concerned Police Station i.e. Sonegaon Police
Station, Wardha Road, Nagpur on 19.4.2012. The
said complaint was regarding cheating and
fabrication of documents by the applicant and
other person by name Shrawan Wakodikar, regarding
some immovable property, allegedly belonging to

said Prakash Bhotmange. On said complaint, notices
were issued on 29.5.2012 and 21.6.2012 to the
present applicant to remain present before the
concerned police station for enquiry.

2.During the argument, learned Counsel for
the applicant submitted that he had purchased
certain immovable property from Shrawan Wakodikar
after compliance of the required provisions as to
taking the search for the title of the vendor and
also by issuance of public notice and satisfying
himself as to the property does not belong to any
third party much less to Prakash Bhotmange. It is
submitted that the property has already been
purchased and sale-deed has already been completed
in favour of the applicant, still only on some
flimsy complaint from Prakash Bhotmange, the
police machinery is asking him to attend the
police station on the pretext of the enquiry. This
has created apprehension in the mind of the
applicant of being arrested in any such
litigation.

3.Considering the circumstances, it is a
fit case in which the present application for
anticipatory bail is required to be allowed and
hence, it is accordingly ordered.

(i)In the event of arrest of the
applicant in the matter of complaint by Prakash
Bhotmange with Sonegaon Police Station, Wardha

Road, Nagpur, he shall be released on executing
P.R. Bond in the sum of Rs.10,000/- (Rupees Ten
Thousand Only) with one surety in like amount.

(ii)In the event of arrest of the
applicant and on availing bail as above, the
applicant shall attend the concerned police
station once on Sunday between 10:00 a.m. to
12:00 noon for first two weeks and thereafter
again once on Sunday at the same time for second
two weeks. The attendance is only for a period of
one month.

With these directions, the present
criminal application is disposed of.
