By consent of parties, we quash and set aside order dated 31.1.2011 passed below Exh.79 in R.P. No. 17/2006 and restore said proceedings for condonation of delay filed by the present petitioner back to file of Debt Recovery Tribunal, Nagpur.
Parties to appear before the DRT Nagpur on 2.8.2011. DRT Nagpur shall attempt to take fresh decision in the matter as early as possible and in any case within further period of two months.
The DRT shall not be influenced by any observations made in its earlier order and after hearing respective parties shall record its independent finding.
