The counsel for the petitioners has submitted that the petitioner is

a sugar factory and has submitted an application dated 12.5.2011 to the Chief Director, Government of India, Directorate of Sugar, New Delhi, with a request for grant of additional free sale quota of 15,000 M.T. to the

petitioners to enable the petitioners to clear the outstanding dues of the sugarcane growers, which is pending for decision before the said authority. The learned counsel for the petitioners has submitted that permission to withdraw the present Writ Petition may kindly be granted and the Central Government may be directed to decide the representation of the petitioners within a stipulated period.

The learned counsel for the respondent nos.1 to 3 states that the representation of the petitioners shall be decided as per the direction of this Court.

On the back drop of the above referred facts, particularly in view

of the pendency of the application of the petitioners dated 12.5.2011

before the competent authority for decision, it will be appropriate to pass the following order:-

Writ Petition is disposed of as withdrawn. The respondent no.2 is directed to decide the representation/application of the petitioners dated 12.5.2011 for release of additional free sale quota of sugar on its own

merits, in accordance with law and procedure applicable in this regard, within a period of six weeks from the date of communication of this

order. Since the application is pending for more than 30 days, we expect

the Central Government to take a decision as early as possible, but in any

¶33

case not beyond the period of six weeks from the date of communication

of this order.
