The petitioner by earlier petition has made the similar prayers and thereby seeking protection on the basis of the allegations contained in the petition that respondents are likely to allow the third party rights and title though his Appeal No.494 of 2006 is pending before the Appellate Division Bench of the Small Causes Court at Mumbai.

After hearing both the sides by order dated 16.7.2010, the Division Bench of this Court dismissed the petition by observing that the petition is premature. The S.L.P. against the said order has also been disposed of.

There are no substantial change of circumstances. Therefore, there is no question of entertaining the present writ petition again. Points to be raised by the petitioner at the appropriate time.
