Heard.
We find the challenge stale. However, learned counsel for the petitioners points out that petitioners thereafter had made grievance before Grievance Committee for release of subsistence allowance and accordingly directions were issued but then subsistence allowance was not received by the petitioners. They further made another representation and the same is still pending. Learned counsel states that he is still awaiting instructions on all these developments.
The suspension pending departmental inquiry was ordered on 25.1.2009 and the petition has been filed on 19.1.2011. It was listed before this Court for the first time on 28.6.2011 and then came to be adjourned for today. Today again learned counsel for

the petitioners is seeking time to obtain further instructions from the petitioners.
In this situation, it is apparent that the petitioners have not contacted the learned counsel during all these periods. Hence, though learned AGP on behalf of respondent no.3 is opposing any liberty, considering the grievance about non-release of subsistence allowance, we permit the petitioners to file fresh petition if the cause still survives after disclosing complete material. Petition is accordingly disposed of. No costs.
