Heard the learned Advocates appearing for the parties. By consent, the following order is passed :
(i) The order dated 16th September 2011 impugned in the above Writ Petition is set aside.
(ii) The Regional Provident Fund Commissioner (I), Regional Office - Mumbai (iii), shall hear the parties on or before 21st December 2011 and pass orders on or before 10th January 2012. In the event of the order being adverse to the Petitioners, the same shall not come into effect for a period of two weeks from the date of its communication to the Petitioners.
(iii) All contentions of the parties are kept open including the contention of the Petitioners that the Regional Provident Fund Commissioner (I), Regional Office – Mumbai (iii) has no locus to hear the matter.
