1. Heard Mr. Mendadkar, the learned counsel for the petitioner.

On 26/11/2009 the Principal of A.D. Joshi Junior College, where the petitioner was studying in 11^th standard, had submitted the petitioner’s caste claim for verification to the respondent – Scrutiny Committee and as per the petitioner, the verification proceedings are still pending. The petitioner further contends that the vigilance enquiry was completed in March, 2011 and she received a copy of the same in the first week of April, 2011. enquiry and has heard nothing thereafter from the Scrutiny Committee.

In the meanwhile, the petitioner has been granted admission to the first year of BE Course in the current academic year on the basis of his undertaking that the caste validity certificate will be submitted by 30/11/2011. On 1/7/2011 and on 22/9/2011 the petitioner has submitted reminders to the Scrutiny Committee and has heard nothing about his pending claim for verification. The petitioner claims that he belongs to “Koli Mahadev” Scheduled Tribe on the basis of the caste certificate issued on 18/5/2005 by the Sub Divisional Officer, Solapur.

Hence, we direct the respondent no.2 – Committee to pass its final order on the pending proceedings of the petitioner’s caste claim that he belongs to “Koli Mahadev” Scheduled Tribe on its own merits and within a period of two months from today. Consequently, the last date to submit the caste validity certificate is extended from 30/11/2011 to 31/1/2012.

The petition is disposed off in terms of the above directions.

Writ to go to the respondent no. 2 - Scrutiny Committee as well as the respondent no.4 – College forthwith.
