It is not disputed that the Award came to be passed on 24th April 2009 and on account on administrative exigencies, the petition could not be presented within the time stipulated. However, it is not disputed that the delay is capable of being condoned by virtue of section 34(3) of the Arbitration & Conciliation Act, 1996.
2] In such circumstances, the motion is made absolute in terms of prayer clause (a). Delay is condoned. Place the petition for admission with Arbitration Petition No.491 of 2010.
