Heard. After extensively arguing the matter, counsel withdraws the application. Permitted. Disposed of as withdrawn. However, the protection of the present applicants, who are close relations of the original complainant also is to be taken care of. This protection is more so as all the present applicants are residing at Bhanas Hiwara, Taluka Newasa, District Ahmednagar while the proceedings are initiated before learned Judicial Magistrate, First Class at Purna, a distance quite far away and difficult to travel. In the result, the learned Judge seized with S.C.C. No.5/2010 at Purna shall not insist personal appearance of the accused/ applicants except for the purpose of recording their statemnets. The applicants will not challenge their identity. So also, complainant Rohidas, father-in-law of Navnath will not insist personal attendance of the accused.

Learned Judge seized with the S.C.C. No.5/2010 to ensure to dispose of the same within one year from the receipt of writ from this Court.
