1.Heard. The accused in custody
since 14.8.2010 in Crime No.158/2010
dt.10.8.2010, registered at Hingoli
City Police Station, have urged to
release them on bail.

2. The nature of accusations

illustrate that from the shop of the
complainant, after treating its iron
shutter, the suspects intruded and
committed theft of Rs.1,34,000/-. It
is informed, Rs.98,000/- are recovered

from the present accused and their
other associates. The chargesheet is
filed. It is also informed by the
learned Counsel for the appellant that
if stringent conditions are to be
imposed, it would be accepted, abided
by the accused/applicants.

3.Learned A.P.P. informs that there
are several other offenses/cases
committed by the accused applicants.
In order to enable him to produce
record, time was given, however,
barring vague statement that the
accused/applicants made a voluntary
statement of committing identical
offenses in the vicinity of Javala
Bazar, Aundha Nagnath, there is nothing
from the investigator in the form of
FIR or another report from the
concerned. There is nothing to
illustrate that the accused applicants
arehabitualoffenders.Since
substantial part of the investigation
is completed, accused applicants
deserve to be released on bail on
conditions.

ORDER

1.The accused/applicants be released
on bail in Crime No.158/2010,
registered at Hingoli City Police
Station for an offense under Sections
457 and 380 of IPC on following terms:

(a)The accused/applicants to furnish
P.R. bond and surety in the sum of Rs.
20,000/- each. After their release on
bail,theyshallattendthe

investigator on every Sunday between 4
to 8 p.m. till conclusion of the trial.

(b)The accused applicants shall not
leave the jurisdiction of Hingoli City
Police Station.

(c)The accused applicants shall not
indulge in any sort of criminal
activities including identical affairs.

(d)If any breach of the terms is
committed, the relaxation showered
today shall automatically come to an
end.
