Perused charge-sheet.

After some arguments, the learned Advocate appearing for the

applicants stated upon instructions that he is not pressing the application for bail on behalf of applicant No. 1 Vasant and applicant No.2 Sachin, and that he is pressing this application only for applicant No. 3 Nitin.

Applicant Nitin is implicated in CR No. 84 of 2011 of MIDC Police

¶19

Station, Latur, in regard to incident dated 16^th May, 2011, in respect of which F.I.R. came to be filed on 26^th May, 2011 by father of Latesh, who died in the

course of occurrence. The prosecution has recorded statements of various

persons and one Shri Sachin Kamble is cited as eye witness. This witness

was present at the door steps of the house of Vasant, and Latesh entered the house. As Latesh did not turn up for a long time, this witness pushed the door and observed certain overt acts. So far as Vasant and Sachin are concerned, this witness further narrated that applicant No. 3 Nitin alongwith others assaulted him with fist and kick blows. He is no way related to the death of Latesh. Therefore, the applicant No. 3 is entitled for bail. Hence, following order is passed to dispose of the present application :

A. Application on behalf of applicant No. 1 Vasant Sonkamble and applicant No. 2 Sachin Sonkamble is allowed to be withdrawn and disposed of accordingly. This Court has not expressed any view for the case of applicant Nos. 1 and 2. B. Applicant No. 3 Nitin Vasant Sonkamble is granted bail in CR No. 84 of 2011 of MIDC Police Station, Latur. He be released on bail in the sum of Rs.20,000/- (Rupees Twenty Thousand) with one surety in the like amount. The applicant shall furnish P.R. Bond of Rs.20,000/- (Rupees Twenty Thousand).

C. The applicant No. 3 Nitin Vasant Sonkamble shall report to the concerned police station on every second Saturday between 11.00 a.m. to 04.00 p.m. till recording of evidence of material witnesses on behalf of the prosecution is over.
