against in accordance with law. That can be no ground to give preference to the present Appeal which, as aforesaid, pertains to year 1999, wherein, the accused have been released on bail. The same will have to proceed under caption `accused on bail’ as per its turn. This Appeal cannot be given precedence as in terms of the present assignment preference will have to be given to Appeals filed by the convicts who are in jail and the oldest matter which is listed under that category before the Court for hearing pertains to year 2004.
