.Heard the learned Counsel for the
respective parties.
2.This is an application for suspension
of sentence and bail by a man in his 30s who
had alleged raped a lady, who was 54 years by
calling her at his house between 2:30 p.m. to
6:00 p.m. and on 29th November, 2006. Report
of the incident was given about 20 days after
the incident. The record from the Mobile
2 Appa 188-2011 Company shows that the victim had talk with her husband for about 134 seconds at 4:31 p.m. and with the applicant himself at 5:08 p.m. for 892 seconds. The applicant was on bail through out the trial. Considering the fact that Appeal is not likely to be taken up for final hearing in the near future as also pendency of older appeals, till the appeal is heard applicant be released on fresh bonds in the same sum on which he was released during the pendency of the trial. Substantive sentence is suspended.
