1 Heard respective learned counsel for the parties.
2 Pursuant to the order dated 9.8.2010, Shri S.D.Kaldate, learned A.P.P. for respondent nos. 2 and 3 filed the report dated 9.8.2010 from the investigating agency and same is taken on record and marked as document ‘X’. Para no.3 of the said report discloses that no sufficient evidence is available against accused no.5, namely K.D.Wategaonkar (B.D.O.) i.e. the petitioner herein to file the chargesheet against him, and therefore, necessary arrangement has been made to delete his name from the offence.

5 It is reported that Smt. Gangwal, learned counsel was appointed through legal aid to represent respondent no.1, and therefore, her fees are quantified at Rs.2,000/- to be paid by Legal Aid Committee.
