Appasaheb Ramchandra Jadhav and Ors. Vs State of Maharasthra and Ors.

The grievance in this petition under Article 226 of the Constitution of India is that in spite of the fact that the petitioner had made an application to the District Collector, Kolhapur under section 12 of the Maharashtra Project Affected Persons Rehabilitation Act, 1986 as far back as on 15th November 2009 and that too after the petitioner's Writ Petition No.13 of 2009 was disposed of by this Court on 10th November 2009 requiring the petitioner to make a representation, the District Collector, Kolhapur has still not decided the petitioner's application dated 15th November 2009.

In view of the above, we dispose of this petition with a direction that the District Collector, Kolhapur shall consider and decide the petitioner's application dated 15th November 2009

under section 12 of the Maharashtra Project Affected Persons Rehabilitation Act, 1986 as expeditiously as possible and in any case not later than 30th November 2010.

In order to enable the Collector, Kolhapur to take into consideration any oral submissions which the petitioner may desire to make, the petitioner shall appear before the District Collector, Kolhapur on 27th October 2010 at 11.00 a.m.. The petition is disposed of accordingly. All concerned to act on an ordinary copy of this order duly authenticated by registry of this Court.
