Mr. Sonawane, learned A.G.P. for the respondent no.2 states that in case the petitioner submits a representation disclosing full facts along with supporting documents, the Education Officer will consider that representation in accordance with law and after hearing the management and, if required, withdraw the order dated 30^th April 2010 which is impugned in the petition.

weeks from today and that before submitting the representation he will serve a copy thereof on the management. Statement is accepted.

In view of the above statements, the respondent no.2 – Education Officer is directed to decide the representation to be submitted by the petitioner in accordance with law and in any case within a period of 8 weeks from the date of submission, and if the respondent no.2 is satisfied that the appointment of the petitioner has been made against an open post in accordance with law, the respondent no.2 shall withdraw his order dated 30^th April 2010 and approve the appointment of the petitioner. Petition is disposed off.
