The Liquidator, Maratha Market Peoples Co-Operative Bank Ltd. (in Liquidation) and Anr. Vs M/S. Sunrise Lifestyles and Homes Pvt. Ltd.

3rd July, 2009, the learned Judge has decreed the suits of the respondents-plaintiffs, and directed the petitioners to deliver vacant possession of the suit premises.

3. The learned counsel appearing of the petitioners submits that a writ is maintainable against the judgment and decree, as jurisdictional issue is involved.

We do not agree with the learned counsel for the petitioners. The petitioners have a remedy of preferring an appeal in the same Court against the said judgment and decree. Therefore, we are not inclined to entertain these two petitions.

The petitions are dismissed, with liberty to the petitioners to seek alternative remedy.
