The students, who are given hostel accommodation at

the Government Colleges Hostel at ‘C’ Road, Churchgate, Mumbai,

have made a grievance that the Public Works Department has

undertaken repairs and renovation work, which are causing discomfort in the studies for the examinations, which are being conducted by the University in April and May, 2010.

On the earlier occasion, we had recorded the assurances of the learned Assistant Government Pleader that the works would be stopped immediately, and the concerned contractor would be informed about the Court order. However, one of the students has mentioned the matter again, and has complained that despite Court orders, the renovation work is going on at site, which causes annoyance and disturbance to students in studies. He states that examinations are going on, and would continue till 23^rd May, 2010.

We had orally directed Mr. Naik, appearing for the State, to take instructions, and the matter was kept back till recess. He, after taking instructions from Ms. M.A. Shinde, Superintendent, Government Colleges Hostel, who is present in Court, states that the Superintendent will not permit any renovation and repair work in the hostel till 25^th May, 2010.

This statement would cover all activities or works, including any drilling activity presently going on. Mr. Naik further assures the Court that the Public Works Department and the concerned Executive Engineer will ensure that court orders are complied with; and no work of renovation and repairs, including drilling activities, is carried on either by P.W.D. by itself or by any contractor engaged by the said Department.

This order is passed in the presence of Mr. V.A. Ahire, Sectional Engineer, from the Public Works Department.

In the light of the assurances given by Mr. Naik, which are accepted as undertakings to this Court, this petition is disposed of.
