Learned Counsel on behalf of the Applicant submits that as per Order dated 6-8-2009 of this Court a sum of Rs.3000/- per month from 11-7-2005 has been deposited by the Respondent and as per Order dated 6-11-2009 a sum of Rs.5000/- has been deposited from November, 2009 till April, 2010.

The statements are accepted. In case the said amounts have not been deposited by the Respondent, the Applicant may take appropriate proceedings against the Respondent.

Learned Counsel on behalf of the Applicant submits that the amount at the rate of Rs.3000/- deposited by the Respondent from 11-7-2005 was withdrawn by the Applicant except a sum of Rs.25,000/- deposited by the Respondent pursuant to application dated 16-9-2009 which the Applicant has not been allowed to withdraw by Order dated 16-9-2009 of the learned Magistrate. In case the Applicant has been withdrawing maintenance amount of Rs.3000/- per month from 11-7-2005 there could not have been

reasonable objection, not to allow the Applicant to withdraw the said sum of Rs.25,000/- by application dated 16-9-2009, on the same terms and conditions.

Consequently, the Order dated 16-9-2009 is hereby set aside and the Applicant is permitted to withdraw the said sum of Rs.25,000/deposited by the Respondent by an application dated 16-9-2009 before the learned Magistrate, on the same terms and conditions, as before.

With the above observations, Criminal Miscellaneous Application No.27 of 2010 is disposed off.
