2.It is stated that the counsel was absent due to
illness on 14-01-2010. It is submitted by Mr. N.N.
Shinde, learned counsel holding for Mr. H.T. Joshi, that
due to old age, Mr. Joshi was suffering from illness and
the absence was unintentional. Considering such reason,
the dismissal order dated 14-01-2010 is recalled and the
petition is restored to its original position with
direction to place it for hearing on 8th March, 2010.
The parties are put on notice that the petition will be
heard finally on the given date at 2.30 p.m. and will be
disposed of. Present civil application is accordingly
allowed.
