P.C . :

At the hearing of the Arbitration Application, counsel appearing

on behalf of the Applicant seeks leave to withdraw the Arbitration Application in view of the fact that an arbitrator has already acted in the matter upon a reference being made by the Respondent. Learned counsel states that his clients have already adopted a remedy in accordance with law and that the withdrawal of the Application shall be without prejudice to the rights and contentions of the Applicant, in regard to the appointment of the arbitrator. The request for withdrawal on these terms is not opposed. The Arbitration Application is accordingly dismissed as withdrawn in terms as prayed.
