applicant/State for condonation of delay
of 8 days caused in filing the
accompanying application, seeking leave
to file appeal against judgment and
order of acquittal dated 7.11.2009.
3) Mr.Shinde, learned Counsel for the
respondentopposedthepresent
application vehemently and submitted
that it bears no substance and same is
therefore, liable to be rejected.
4) For the reasons stated in the
application, it appears that the
applicant has explained the delay
satisfactorily. Moreover, it also
appears that the said delay is not

willful, deliberate and intentional and
certainly it is not inordinate and the
delay deserves to be condoned in the
interest of justice.
5) In the result, the present application
is allowed in terms of prayer clause (B)
thereof and delay of 8 days caused in
filing the accompanying application
seeking leave to file appeal, stands
condoned and present application is
disposed of accordingly.
