By this application, the applicant seeks

bail in connection with C.R. No.100 of 2009 for

an offence punishable under sections 302, 143, 147, 148, 506 read with 34 of the I.P.C.

The prosecution case is that the applicant and others were travelling in a pick up van. The deceased was travelling in a rickshaw and

some persons from the rickshaw had got down at a place as a result of which obstruction was caused to the pick up van to pass. There was some altercation between the driver of the pick up van and the deceased. The persons travelling in the pick up van asked the driver of the pick up van to kill the deceased, as a result of which the driver of the pick up van knocked down the deceased and the deceased died on the spot.

Chargesheet has been filed. The only allegation against the present applicant is that the travellers in the pick up van had instigated the driver to knock down the deceased. No specific role has been attributed to the present applicant.

Two other persons travelling in the pick up van have been granted bail by this Court vide order dated 9^th November 2009 passed in Criminal Application No.4223 of 2009. The

applicant is entitled to bail on the ground of parity. Hence, I pass the following order:

The applicant be released on bail on executing a personal bond in the sum of Rs.15,000/ with two sureties of the like amount, subject to the condition that the applicant shall report to the concerned police once a month in the first week of every British calendar, till the conclusion of the trial.
