The dead body was found on 3lst August, 2009 at the instance of Mohan Takale and discovery of shoe was made at the instance of the applicant on 14.10.2009. The other shoe was stated to have been recovered on 3.9.2009. There is nothing to show that the applicant was contacted on his mobile phone from one SIM card which was found at the spot. Considering the fact that even according to prosecution case the applicant is alleged to have driven the jeep in which victim and the assailant travelled and shoe of the victim was produced after victim’s dead body was thrown and since Maruti Kamble, the person who had alleged actually participated in the murder has already been bailed out, the applicant be also admitted to bail on the same terms.
