01.Heard.

¶10

02.This Court had granted temporary bail
to the applicant on the ground that his child
suffers from congenital heart disease for which
he is required to be operated at Nagpur.

03.By this application, petitioner seeks
extension of bail on the ground that he has
securedfinancialhelpfromvarious
institutions, and the operation may be performed
within two months.

04.Learned Adv. Ms. Nisha Gajbhiye for the
applicant states that if the amount is collected

and deposited in the Superspeciality Hospital at
Nagpur, the medical experts, who have to arrive
from Mumbai, shall give appointment, and on the
dates so scheduled, the child of the petitioner
will have to be operated.

05. We had called for the report from Police.

¶16

06.After instructions, learned APP Mr.
Mirza reports that the grounds on which the
temporary bail is sought are genuine. Learned
APP, however, states that it is not clear as to
when the operation may be done and how long the
applicant will remain at large. He, therefore,
urges that let the applicant ascertain the
schedule of surgical operation from the sources
explored by him and his request for temporary
bail may be considered afresh after the
appointment is fixed for surgery.

07,We are satisfied that the stand taken
by the learned APP is reasonable. We,
therefore, pass the following order:-

[a]The temporary bail granted by this
Court is extended till 24th
December, 2010. Soon thereafter,
applicant shall return to jail to
undergo the sentence.

[b] After the Superspeciality Hospital schedules the surgery, its

intimation be given to the
Superintendent,CentralJail,
Amravati, and to applicant and
thereafter Superintendent concerned
shall again release the applicant on
bail for a period of one month on
fresh bail bond and surety bond of
Rs.5,000/- [rupees five thousand
only].

08.With these directions, we dispose of
this application.
