1]By consent of the parties, appeal is

disposed off in following terms.

¶15

2]The award passed by the Labour Court in
Reference (IDA) No.914 of 1994 and the order passed

¶16

by the learned Single Judge of thi8s Court in writ
petition Nos.2512 of 2003 and 2795 of 2003 are set
aside.

3]The workman is permitted to withdraw the

¶18

amount of Rs.3,07,439/- which has been deposited by
the employer in this Court pursuant to the order
dated 13th August 2004 alongwith accruals thereon.

¶19

After withdrawing the amount, if the amount

¶20

withdrawn is less than Rs.5,00,000/-, the workman
shall communicate the amount actually withdrawn and
the difference between the amount withdrawn and Rs.

¶21

5,00,000/- to the employer within a period of two

¶22

weeks from the date of getting this intimation, the
employer shall pay the amount of shortfall to the

workman immediately.

¶25

4]The workman would be paid an amount of Rs.
3,25,000/- by the employer as the amount of

gratuity and Provident Fund and in addition if any
interest is payable on the amount of Provident Fund
within a period of four weeks from today.

5]These payments are made in full and final
settlement of all claims between the workman and
employer.
