The appellant takes exception to the
order passed by the learned Company Judge dated
9-9-2009. It is the contention of the
appellant that prejudice would be caused to the
rights of the appellant in as much as one Smt.
Nirmala Bhosale, who was appearing as counsel
for the Company, has been appointed to Chair
the Meeting. A perusal of the record would
reveal that the order dated 9-9-2009 has been

passed with the consent of both the parties.
It is further to be seen that apart from a bald
allegation regarding bias against the said
counsel, the appellant has not placed any
material on the record to substantiate his said
allegation. No case is made out for
interference in the impugned order. The appeal
is dismissed. Needless to say, the interim
relief granted stands vacated.
