Shri Ajay Kaushal Presently Lodged in Judicial Custody Sada Jail Vasco Vs State of Goa through P.P. and Anr.

Petitioner in this case seeks to challenge the detention of the petitioner who has been convicted for the commission of the offence of kidnapping and assaulting in U.K., on the grounds that the Courts below are under obligation to hear his bail application and consider the issue as to how long he is to be kept in the custody awaiting extradition proceedings.

Learned Advocate Nadkarni, for the petitioner submits that he would be taking steps to move an application for bail on behalf of the petitioner in the Court of District & Sessions Judge, South Goa Margao and necessary direction be given to the District and Sessions Judge, to dispose off the said bail application expeditiously in accordance with law. State has no difficulty in getting this petition disposed off with the directions as solicited by the petitioner. Hence

the Order.

District & Sessions Judge at South Goa Margao shall dispose off the application for bail if any moved on behalf of the petitioner expeditiously, preferably within a period of week from the date of filing the application in accordance with law. This petition stands disposed off accordingly.
